Tennessee Board of Dentistry , 04-3293, Davidson County Tennessee Chancery Court (2005) Mr. Robbins represented a licensed dentist who had written three letters with political content. When the licensing board determined that the letters established probable cause to order the dentist to submit to a mental health examination, it ordered the dentist to submit to such an examination. Following a hearing before the board on a charge that the dentist had willfully violated this order, by refusing to submit to such an examination, the board suspended the dentist's license. On appeal, Mr. Robbins obtained a reversal and dismissal of this charge and the license suspension on the ground that it was without probable cause, arbitrary and capricious. The effect of this ruling was to restore the client's license to practice dentistry without sacrificing the right of free speech guaranteed by the First Amendment.
