An appeal is not a new trial, but a review by an appellate court to determine whether the trial court properly handled your case. Even after you have exhausted your appeal options, you may still have a review option. If you can show prejudice as a result of particular circumstances, you may wish to pursue post conviction review (in state court) or habeas corpus review (in federal court).
I will examine the record thoroughly when seeking to demonstrate that you were deprived of your rights guaranteed by the constitution and that the deprivation prejudiced the verdict in your case. Post conviction or habeas corpus review may be available if:
Ineffective Assistance of Counsel (IAC)
Review based on a claim of ineffective assistance of counsel may be successful if the defendant's attorney did something that he or she should not have done or failed to do something that he or she should have done. I will interview the client, talk to the lawyer who tried the case and examine the record to determine whether the review is appropriate.
