This is sometimes called "simple possession" because there is no proof of any intent to sell or distribute the illegal drug. For marijuana, such a first offense simple possession case will subject the offender to up to one year imprisonment. A second such "simple possession" offense involving marijuana will bring an enhanced sentence of 2 to 10 years. Cocaine and Crack are subject to the 2 to 10 years even on a first offense of "simple possession." Of course, if there is such an intent to sell or distribute the drug which is attached to the possession, the penalties are significantly enhanced.
